Rare Chemicals GmbH has not appointed a Data Protection Officer. There is no statutory obligation to do so, as fewer than 20 persons are permanently engaged in automated processing of personal data (Section 38(1) BDSG) and the core activities of the company do not consist of large-scale processing of special categories of personal data or systematic monitoring of individuals (Art. 37(1)(b), (c) GDPR). 2. Scope and B2B Context
This Privacy Policy applies to the website www.rarechem.de and to all business communications, pre-contractual measures, and contractual relationships of Rare Chemicals GmbH.
Rare Chemicals GmbH provides its services exclusively to companies, public authorities, and other legal entities under public or private law (B2B). We do not supply consumers within the meaning of Section 13 of the German Civil Code (BGB). The personal data processed therefore relates solely to natural persons acting as contact persons, representatives, or employees of our business partners. This Privacy Policy fulfils the information obligations under Art. 13 GDPR (direct collection) as well as Art. 14 GDPR (data not collected directly from the data subject).
3. Purposes and Legal Bases of Data Processing
3.1 When Visiting Our Website
When you visit our website for informational purposes only, we collect only the data that your browser automatically transmits to our server (server log files):
IP address (automatically deleted after 30 days)
Date and time of access
URL accessed, volume of data transferred
Browser type, version, and operating system
Referrer URL (previously visited page)
Purpose: Ensuring the technical operation and security of the website.
Legal basis: Art. 6(1)(f) GDPR (legitimate interest).
Retention period: 30 days, after which data is deleted automatically.
3.2 Contact Enquiries
When you contact us by e-mail, contact form, or telephone, we process the following data:
First and last name of the contact person
Company name and role/position
Business e-mail address
Business telephone number (if provided)
Content and timestamp of your enquiry
Purpose: Processing and responding to business enquiries; initiating business relationships.
Legal basis: Art. 6(1)(b) GDPR (pre-contractual measures) and Art. 6(1)(f) GDPR (legitimate interest in processing business enquiries).
Retention period: 3 years after final processing, provided no contract is concluded and no longer statutory retention obligations apply.
Consequences of non-provision: If you do not provide contact details, we are unable to process your enquiry or establish contact.
3.3 Contractual Relationships
To initiate and perform contracts, we process contact data of the contact persons of our business partners, in particular:
Name and role of the contact person
Business contact details (address, phone, e-mail)
Correspondence in the course of contract performance (e-mails, order documents)
Order, delivery, and invoice data
Purpose: Performance of the contract with the respective company.
Legal basis: Art. 6(1)(b) GDPR (contract performance) for data of sole traders; Art. 6(1)(f) GDPR (legitimate interest) for contact data of representatives of legal entities. Where statutory retention obligations apply: Art. 6(1)(c) GDPR.
Retention period: 10 years from the date the business documents were created (Sections 257 HGB, 147 AO — German Commercial Code and Tax Code). Contact data no longer required for contract performance will be deleted once the legitimate interest ceases to apply.
Consequences of non-provision: Without contact details for a responsible person, it is not possible to process the contractual relationship.
3.4 Data Not Collected Directly from the Data Subject (Art. 14 GDPR)
Where personal data of contact persons is provided to us by their employer (our business partner) without being collected directly from the data subject, this Privacy Policy also applies. We process such data solely within the scope of the contractual relationship with the respective company. The legal basis is Art. 6(1)(f) GDPR. Data subjects are requested to take note of this Privacy Policy.
4. Disclosure of Personal Data
Personal data is only disclosed to third parties in the following cases:
Processors (e.g. IT service providers, hosting providers) under a data processing agreement pursuant to Art. 28 GDPR
Logistics and shipping service providers for order fulfilment (to the extent necessary for contract performance)
Authorities and courts where there is a statutory obligation to disclose
International transfers: Rare Chemicals GmbH maintains business relationships with international customers. Where personal data (e.g. contact details of contact persons) is transferred to countries outside the EU/EEA in the course of these relationships, such transfers are made either on the basis of an adequacy decision by the EU Commission (Art. 45 GDPR), standard contractual clauses (Art. 46(2)(c) GDPR), or, in individual cases, under Art. 49 GDPR (e.g. for contract performance). We will inform you of the safeguards applied upon request.
5. Hosting
Our website is hosted by Strato AG, Pascalstrasse 10, 10587 Berlin, Germany. A data processing agreement pursuant to Art. 28 GDPR is in place. The servers are located in Germany. For further information on data protection at Strato, please visit www.strato.de/datenschutz.
6. Cookies
Our website uses only technically necessary session cookies that are required for the proper operation of the website. These cookies are deleted automatically when you close your browser. Consent under Section 25 TDDDG (German Telecommunications-Telemedia Data Protection Act) is not required for technically necessary cookies.
We do not use analytics, marketing, or tracking cookies or any other non-essential cookies.
7. Right to Object (Art. 21 GDPR) — Important Notice
IMPORTANT NOTICE PURSUANT TO ART. 21(4) GDPR
Where we process personal data on the basis of Art. 6(1)(f) GDPR (legitimate interest), you have the right to object to such processing at any time on grounds relating to your particular situation (Art. 21(1) GDPR). We will then no longer process the data unless we can demonstrate compelling legitimate grounds for the processing that override your interests, rights and freedoms, or the processing serves the establishment, exercise, or defence of legal claims.
Where personal data is processed for direct marketing purposes, you have the right to object at any time and without giving reasons to the processing of your personal data for such marketing (Art. 21(2) GDPR). Following an objection, your data will no longer be processed for direct marketing purposes.

In addition to the right to object (Section 7), you are entitled to the following rights:

Right to erasure (Art. 17 GDPR): You may request deletion of your data under the statutory conditions. This right does not apply where statutory retention obligations preclude erasure.

10. No Automated Decision-Making (Art. 22 GDPR)
We do not use fully automated decision-making pursuant to Art. 22 GDPR for the purpose of initiating, performing, or concluding the business relationship or for pre-contractual measures. Should we employ such processes in individual cases, we will inform you separately and, where required by law, obtain your consent.
11. Data Security (Art. 32 GDPR)
We implement appropriate technical and organisational measures (TOMs) pursuant to Art. 32 GDPR to ensure a level of security appropriate to the risk. These include in particular SSL/TLS encryption of the website and access controls on internal systems. Our security measures are reviewed regularly and updated in line with the state of the art.
